O R D E R

The grievance of the petitioner in this case was that the Station House Officer,

I Town Police Station, Ananthapur, was harassing him and his brothers by calling them to the police station frequently and threatening them. He further alleged that the police were interfering in his civil disputes with the third respondent in relation to the property bearing door No.20-12-1, near Tadipathri Bus Stand, Old Town, Ananthapur.

The Sub-Inspector of Police, I Town Police Station, Ananthapur, filed a counter-affidavit denying the petitioner's allegations of harassment and interference in civil disputes. He stated that the third respondent herein had lodged a complaint on 08.07.2011 basing on which Crime No.215 of 2011 under Section 506 IPC had been registered against the father of the petitioner on the file of the I Town Police Station, Ananthapur District. He categorically stated that the petitioner's allegations as to interference with him or his brothers by calling them to the police station and asking them to vacate the shops were factually incorrect. No reply affidavit was filed rebutting the averments in the above counteraffidavit.

In the light of the clear stand taken by the police authorities in their counter, this Court finds no reason to interfere in the matter. Needless to state, in the event the police authorities need to summon and examine the petitioner in connection with the case registered against his father, they are bound to do so in accordance with the due procedure laid down in the Code of Criminal Procedure. Reserving liberty to the police authorities to do so, the writ petition is closed. Pending miscellaneous petitions shall also stand closed. No order as to costs.
