Petitioner was working as Driver. He was declared as unfit to drive due to his medical condition and was retired on medical grounds vide proceedings dated 13.7.2006. Grievance of the petitioner is, he is not provided alternative employment or financial benefits as required under the Persons with Disabilities, Equal Opportunities, Protection of Rights and Full Participation Act, 1995 or at least his son should have been given employment. Praying to provide employment, he made several representations starting from 1.6.2007, but so far his grievance is not redressed. On account of his premature retirement, family is suffering financial hardship and family needs a bread winner. According to petitioner, the benefit of compassionate appointment to family of employee retired on medical grounds is reintroduced on 3.6.2015 and in terms thereof employment ought to have been provided to his son. After the reintroduction of the Scheme also petitioner made representation on 23.5.2016.
Counsel for petitioner contends that such inaction is illegal and amounts to arbitrary exercise of power.
Since grievance of petitioner is not redressed and stand of respondent- Corporation is not known, I am not inclined to entertain and keep the Writ Petition pending.
PNR, J W.P.NO. 13448 OF 2017 The Regional Manager, 2nd respondent is directed to examine the claim of petitioner to provide employment under the Scheme notified vide Circular No. PD19/2015 dated 3.6.2015 and furnish reply to petitioner in response to several representations made by him by a reasoned order, as expeditiously as possible, preferably within a period of two months from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous Petitions, pending if any, shall stand closed.
