THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO CRP.No.2704 of 2014 ORDER :

A Full Bench of this Court in Kode Kutumba Rao v. Kode Sesharatnamamba[1], held that an order passed under Section 24 of the Hindu Marriage Act, 1955 is appealable under Section 28, and not revisable under Section 115 C.P.C. Since the present Revision is filed under Article 227 of the Constitution of India, having regard to the existence of a right of appeal under Section 28, I am of the view that this Revision is not maintainable. 2.

Therefore, granting liberty to petitioner to challenge the order granting interim maintenance passed under Section 24 of the Hindu Marriage Act, 1955 by way of an appeal, this Revision is dismissed. No order as to costs.

3. The Registry is directed to return the certified copy of the impugned order to the counsel for petitioner immediately to enable the counsel to take appropriate steps in the matter.

As a sequel, miscellaneous petitions pending, if any, in this Revision shall stand closed.
