THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.29321 OF 2015 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue.

The petitioners claim to be the owners of private patta lands being part of Plot Nos.12 & 13, and Plot No.14 in Survey No.511-1B2 in Ward No.II, B.K Palle Revenue Village, Madanapalle Mandal, Chittoor District. Alleging that the 5th respondent is insisting on production of 'No Objection Certificate' (NOC) from the 3rd respondent to register the sale deed in respect of the subject plots, the present Writ Petition is filed. The averments made in the Writ Petition state that the lands claimed by the petitioners are private patta lands and not the Government lands. Since the subject lands are private patta lands, no NOC is required, unless they are owned by Ex-servicemen or political sufferers. In these circumstances, the Writ Petition can be disposed of with a direction to the 5th respondent to receive and process the document in question without insisting on production of NOC from the 3rd respondent. The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
