THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.1773 of 2011 ORDER:

This petition under Section 482 Cr.P.C. is filed by the petitioner seeking to call for the records pertaining to M.C.No.27 of 2008 on the file of the Judicial Magistrate of First Class, Armoor and quash the order dated 27-10-2010 passed by the Sessions Judge, Nizamabad in Crl.R.P.No.16 of 2010.

Even though the Criminal Petition is not maintainable as it amounts to second revision, since the Criminal Petition was admitted by this Court on 25-02-2011, the Criminal Petition is being disposed of as under :

The order passed by the trial Court and the order passed by the first revision court confirming the order passed by the trial Court are pertaining to the year 2010 and at that time, the order was passed directing the petitioner herein to pay monthly maintenance at the rate of Rs.1,500/- and Rs.1,000/- to Respondent Nos.2 and 3 herein respectively and this Court by way of an interim order dated 25-022011 granted interim stay directing the petitioner to pay monthly maintenance at the rate of Rs.1,000/- and Rs.750/- to Respondent Nos.2 and 3 herein respectively. It is informed by the learned counsel for the petitioner that the petitioner is regularly paying the maintenance as directed by this court.

Considering the facts and circumstances of the case, the present Criminal Petition can be disposed of with the following directions : The petitioner herein is directed to pay monthly maintenance at the rate of Rs.1,500/- and Rs.1,000/- to Respondent Nos.2 and 3 herein respectively from the month of December, 2015 and he shall continue to pay the same.

Consequently, Miscellaneous Petitions pending, if any, in this Criminal Petition shall stand closed.
