HONOURABLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.20788 of 2016 ORDER:
The notice dated 26.03.2016 issued by the Revenue Divisional Officer, Kothagudem, is challenged by the petitioners primarily on the ground that Chathakonda Village comes within the agency area and the Revenue Divisional Officer has no competency to deal with the properties located in the agency area and it is only the Special Deputy Collector (Tribal Welfare), who is competent to adjudicate the disputes with reference to the landed properties and in regard to said submission, this Court granted interim order on 29.06.2016.
When the matter is taken up, learned counsel for the petitioners and learned Government Pleader for the official respondents fairly submitted that the Revenue Divisional Officer has no jurisdiction and the unofficial respondent be given liberty to go before the Special Deputy Collector (Tribal Welfare) on the grievance agitated earlier before the Revenue Divisional Officer. Therefore, the impugned notice dated 26.03.2016 is not sustainable and it is set aside. The 5th respondent is granted liberty to workout his remedies available under law on his grievance initially filed before the Revenue Divisional Officer who has no jurisdiction and in pursuance to which, the impugned notice was issued.
