HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.7112 OF 2017 ORDER:

Heard learned counsel for the petitioners/ A1 and A2 among five accused of Crime No.269 of 2017 on the file of Karimnagar II Town Police Station, originally the F.I.R. registered according to the petitioners and from perusal against three persons. Thus, these two petitioners and from the remand report arrested and amended F.I.R. shows two accused it discloses in the remand report as A1 and A2 and also heard learned Public Prosecutor appearing for the State, before ordering notice to respondent No.2/ de facto complainant-Medical Health Officer, Karimnagar and perused the grounds in the Criminal Petition, F.I.R. and the remand report.

A perusal of the material no way enables the Court to interdict the investigation, much less, to keep the matter pending. Having regard to the above, the Criminal Petition is disposed of, by left open all the available defences of the petitioners/ A1 and A2 to place any material with the investigating officer during investigation or otherwise as the case may be. It is needless to observe that if at all any arrest of the petitioners is required, the Police strictly follow Section 41A Cr.P.C. and the guidelines of the Apex Court as laid down in Arnesh Kumar v. State of Bihar1.
