THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.28726 of 2017 ORDER:

This writ petition is filed for the following relief: "...to issue an appropriate writ, order or direction more particularly one in the nature of a Writ of Mandamus declaring the inaction on the part of the 2nd respondent in not renewing the license for the petitioners shops is illegal, void, arbitrary, Article 14, 19 and 21 of the Constitution of India and contrary to the GHMC, Act and consequently direct the respondent No.2 to renew the license of the petitioners shops for the year 2017 to 2018 to run the wholesale and retail chicken shops..."

Heard learned counsel for the petitioner, learned Government Pleader for Municipal Administration and Urban Development (Telangana) for respondent No.1 and learned Standing Counsel for respondent No.2.

When the mater is called, it is brought to the notice of this Court by the learned Government Pleader as well as learned Standing Counsel that seeking a direction for renewal for the period 2016-2017, the petitioners herein filed W.P.No.13034 of 2016 and this Court disposed of the said writ petition by order, dated 20.04.2016, directing the second respondent to consider the petitioners' applications dated 01.04.2016 for grant of renewal. It is also brought to the notice of this Court that alleging violation of the said order, the petitioners filed C.C.No.2257 of 2016 and it is pending consideration.

In view of the above, no relief can be granted in the present writ petition in favour of the petitioners. Accordingly, the writ petition is dismissed, giving liberty to the petitioners to pursue the above case.

Consequently, miscellaneous petitions pending, if any, shall stand disposed of. There shall be no order as to costs. ____________________ A.V. SESHA SAI, J Date: 28.08.2017 TJMR
