THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.3004 OF 2017 ORDER:

The alleged inaction on the part of the Joint Collector (Civil Supplies), Srikakulam - 2nd respondent, in disposing of the appeal filed by the petitioner on 04.11.2016, against the order of cancellation of authorization of the fair price shop, issued by the Revenue Divisional Officer, vide proceedings Rc.No.08/2016 CS, dated 28.07.2016, is under challenge in the present writ petition.

Heard Sri K.Ramakoteswara Rao, learned counsel for the petitioner and learned Government Pleader for Civil Supplies (A.P.) for the respondents.

According to the petitioner, he was appointed as fair price shop dealer, in respect of shop No.20, Baruva Village, Sompeta Mandal, Srikakulam District, in the year 2005. The Revenue Divisional Officer, followed by a show-cause notice, passed an order vide proceedings Rc.No.08/2016 CS, dated 28.07.2016, cancelling the authorization of the petitioner herein.

Aggrieved by the said order of cancellation, the petitioner herein preferred statutory appeal on 04.11.2016, before the 2nd respondent - Joint Collector. The grievance in the present writ petition is, though considerable time has lapsed, no orders have been passed on the said appeal and

AVSS,J W.P.No.3004 of 2017 because of the same, the petitioner herein is put to lot of hardship and inconvenience.

Having heard the submissions of the learned counsel for the petitioner and learned Government Pleader, this Court is of the considered opinion that the ends of justice would be served, if the 2nd respondent - Joint Collector is directed to pass appropriate orders on the appeal dated 04.11.2016, said to have been filed by the petitioner herein, against the order of cancellation dated 28.07.2016, by fixing some timeframe. 6.

For the aforesaid reasons, the writ petition is disposed of, directing the Joint Collector - 2nd respondent herein to pass appropriate orders on the appeal dated 04.11.2016, filed by the petitioner, against the order of cancellation passed by the Revenue Divisional Officer, vide proceedings Rc.No.08/2016 CS, dated 28.07.2016, within a period of three months from the date of receipt of a copy of this order, after giving notice and opportunity of hearing to the petitioner herein.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
