THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No.21736 of 2015 ORDER:

The petitioner was appointed as fair price shop dealer of shop No.1 of Tallur Village and Mandal, Prakasam District. While so, the Food Inspector, Podili inspected the shop on 09.08.2014 and found no variation in the stocks. However, he submitted a report on 09.08.2014 stating that one M. Ravidra Reddy was acting as a dealer in place of original dealer. On receipt of the said report, the third respondent-Sub-Collector/Revenue Divisional Officer, Kandukur, issued a show cause notice on 20.08.2014 to the petitioner.

The petitioner submitted his explanation on 26.08.2014.

Ultimately, an order was passed cancelling the authorization of the petitioner on 23.02.2015. Against the said order, the petitioner preferred an appeal before the second respondent-Collector (CS), Prakasam District at Ongole on 04.03.2015.

The second respondent confirmed the order of the third respondent dated 23.02.2015, by order dated 30.06.2015. Challenging the same, the present writ petition is filed.

In view of the availability of alternative remedy of further appeal to the District Collector or revision to the Commissioner of Civil Supplies, this Court is not inclined to interfere with the order passed by the second respondent dated 30.06.2015 at this stage. In the circumstances, liberty is given to the petitioner to avail alternative remedy by taking appropriate steps in accordance with law, within a period of 15 days from the date of receipt of a copy of this order.

Subject to the above observations, the writ petition is disposed of. Miscellaneous Petitions, if any pending in this writ
