HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.15636 of 2009 ORDER:

Mr. P. Sridhar Reddy, counsel for petitioners, having regard to digging of canal up to the fringes of land proposed to be acquired and having regard to the stand taken in the counter-affidavit and inability of petitioners to file rebuttal to the stand taken in the counter-affidavit, has made submissions for consideration and payment of compensation under Section 24 of Act 30 of 2013.

Learned Assistant Government Pleader submits that the case of the petitioners is considered for payment of compensation under Act 30 of 2013 even if land acquisition proceedings are initiated under the Old Act is continued.

The statement is placed on record. As no other point is urged, for the reasons stated above, the writ petition is dismissed, however, with the above observation. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
