THE HON'BLE SRI JUSTICE K.C. BHANU AND THE HON'BLE MRS JUSTICE ANIS WRIT PETITION No.16636 OF 2015 ORDER: (per Hon'ble Sri Justice K.C.Bhanu) This Writ Petition, under Article 226 of the Constitution of India, is filed to call for the records relating to the order, dated 03.06.2015, in Original Application No.2665 of 2015 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad and set aside the same.
2. The petitioner herein/applicant filed aforesaid Original Application questioning the impugned proceedings Rc.C7-117773/2015, dated 17.04.2015, issued by the 2nd respondent, whereby the petitioner was transferred from Town Planning Section, Vijayawada Municipal Corporation to Horticulture Section. The Tribunal, upon considering the material on record, dismissed the Original Application on the ground that as the applicant did not file copy of his original appointment as chairman, he cannot take shelter under Rule 14 (b) of the Andhra Pradesh Last Grade Service Rules.
3. Now the petitioner filed copy of his initial appointment order issued by the 2nd respondent vide proceedings Rc.C24-13077/95, dated 25.09.1995, whereunder he was appointed as chairman on compassionate grounds. In view of filing of appointment order, impugned order is liable to be set aside.
4. Accordingly, the Writ Petition is allowed setting aside the order, dated 03.06.2015, in Original Application No.2665 of 2015 passed by the Andhra Pradesh Administrative Tribunal and the matter is remanded to the Tribunal fresh disposal.
We request the Tribunal to dispose of the Original Application within a period of three (3) weeks from the date of receipt of a copy of this order after giving reasonable opportunity to both the parties. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. _______________________ JUSTICE K.C.
