HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 31748 of 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the in action of respondents in not conducting survey and not fixing the boundaries in respect of land admeasuring 738 square yards in Sy.No.56/ 13 and 56/ 14 of Rushikonda Village, Visakhapatnam, as illegal and arbitrary. 2) The Government Pleader for Revenue (AP), would submit that since it is residential plots falling within the limits of GVMC, the revenue authorities cannot undertake any survey and the GVMC is the proper authority to conduct survey. 3) The learned counsel for the petitioner would submit that the petitioner also made a representation to the GVMC on 03.02.2017 for conducting the survey, in respect of land referred to above. 4) Sri S.Lakshmi Narayana Reddy, learned Standing Counsel for GVMC, submits that if the said representation is still pending consideration, the GVMC shall deal with the same in accordance with law at the earliest.

5) Having regard to the above, the Writ Petition is disposed of, directing the 2nd respondent to pass order on the representation dated 03.02.2017, as early as possible, preferably, within a period of four to six weeks from the date of receipt of a copy of the order.

6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
