O R D E R

(Per Hon'ble Sri Justice Sanjay Kumar) This writ petition was filed assailing the e-auction sale notice dated 18.11.2016 issued by the Lakshmi Vilas Bank Ltd., proposing to hold the auction of the secured asset on 23.12.2016.

It is now represented by Ms.G.Padmini, learned counsel representing Sri K.Mallikarjuna Rao, learned counsel for the respondent-bank, that the sale proposed to be held on 23.12.2016 did not materialize for want of bidders. That being so, the challenge in this writ petition to the sale notice dated 18.11.2016 is rendered purely academic and does not warrant consideration on merits. In the event any amount has been deposited pursuant to the order dated 22.12.2016 passed in this writ petition, the same shall be appropriated to the loan account concerned. The writ petition is accordingly dismissed. It is left open to the petitioners to invoke appropriate remedies in accordance with law as and when a fresh cause of action arises.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No costs.
