HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI Writ Petition No.31877 of 2018 ORDER: {Per Hon'ble Sri Justice Ramesh Ranganathan} The allegation in the writ petition is that certain officials of the respondents-bank were coming to the petitioners' residence, and were creating a scene thereat. The petitioners would submit that, since legal proceedings have already been initiated against them and their family by filing O.As before the Debt Recovery Tribunal, Visakhapatnam, officials of the respondents-bank were wholly unjustified in visiting their house, and in creating a scene thereat.

Particulars of the persons, who are alleged to have come to the petitioners' house, are not stated in the writ affidavit. When we pointed this out to him, Sri P.Rama Sharana Sharma, learned counsel for the petitioners, would seek permission to withdraw the writ petition with liberty to file a complaint before the concerned police officials. In the light of the submissions made by the learned counsel for the petitioners, the Writ Petition is dismissed granting liberty to the petitioners to avail such other remedies, as are available to them in law, against the persons who they claim had trespassed into their house. Miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
