THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.5857 of 2017 ORDER:
The complaint of the petitioners in the present Writ Petition is the alleged inaction on the part of Respondent Nos.2 to 4 in taking action against R.5 and R.6 despite the report submitted to the Hon'ble Lokayuktha.
A Counter affidavit deposed by the Executive Officer of Sri Anjaneya Swamy Temple, Rayadurg, is filed saying that a detailed enquiry was conducted by the Deputy Commissioner/ R.4, against Respondent No.6, who found that R.6 collected the donations and took up the developmental activities in the temple without crediting the same to the temple account and without following norms and procedure of the Department. It is further stated that the Commissioner, Endowment Department also instructed the Executive Officer to recover Rs.17,559/ - incurred over and above the valuation of the work for erecting transformer, cost of Rs.250 bags of cement, cost of crushing stones as per law and also directed to file criminal complaint against R.6. It is further stated that the complaint before the concerned police had already been lodged and it is pending for consideration.
When the matter is taken up, it is submitted by Sri A. Srikanth Reddy, the learned counsel for the Respondent No.5, that the concerned police officer has not registered any crime so far and they are approaching Deputy Superintendent of Police for
appropriate directions to the Station House Officer. It is also stated in the Counter Affidavit that after submission of the report before Lokayukatha in Complaint No. No.746 of 2015, the complaint as against R.7 was closed.
Having regard to the above developments, the present Writ Petition stands disposed of placing on record the above submissions with a further direction to respondent No.5 to proceed in accordance with law against respondent No.6. With the above direction, this Writ Petition is disposed of. As a sequel, the miscellaneous petitions, if any, pending shall stand closed.
