THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.31908 OF 2018 ORDER:

Heard the learned counsel for the petitioner, and the learned Government Pleader for Prohibition and Excise appearing for respondent Nos.1 and 2.

The counsel on both sides state that the issue raised in this writ petition is covered by the order dated 26.12.2017 passed in W.P.No.44088 of 2017.

Therefore, for reasons alike, the present Writ Petition is disposed of, directing the second respondent to release the Tata ACE Auto belonging to the petitioner bearing registration No. TS-20-T-0996 subject to final orders to be passed in the criminal proceedings, and on petitioner furnishing a fixed deposit of Rs.40,000/- from any nationalized bank in favour of the second respondent, and also on production of original R.C. book and on petitioner further giving an undertaking that he will not transfer or alienate the vehicle to any third party in any manner and will maintain the vehicle in the same good road-worthy condition without changing its major parts and features, and would produce the same as and when directed to be produced before the competent authority.

Accordingly, the Writ Petition is disposed of with the above directions. However, it is made clear that confiscation proceedings may go on. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
