THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.31809 OF 2018 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Prohibition and Excise appearing for the respondents.

When the matter is taken up, it is submitted by the learned counsel for the petitioner so also the learned Government Pleader that, in identical situation, this Court disposed of W.P.No.43147 of 2017, by way of an order, dated 20.12.2017. A copy of the said order is placed on record.

Following the above said order and, for the reasons recorded therein, this Writ Petition is also disposed of, directing the petitioner herein to make an appropriate application before the Deputy Commissioner of Prohibition and Excise, Warangal-second respondent herein, enclosing thereto a Fixed Deposit Receipt for Rs.20,000/- (Rupees twenty thousand only) drawn in favour of the second respondent on any Nationalised Bank; and, on such application being made by the petitioner, the subject stock aforestated shall be given to the interim custody of the petitioner. However, it is open for the respondents herein to proceed with the confiscation proceedings. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
