HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.31790 of 2018 ORDER:
1) The present writ petition came to be filed seeking issuance of writ of mandamus directing the respondents herein particularly respondents 3 and 4 not to consider the application No. NIN011801080629 dated 26.07.2018, submitted by the respondents 5 and 6 vide, for mutation of their names in the revenue records and for issuance of pattadar pass books and title deeds in respect of lands situated at Sy.Nos. 8, 9/ 1, 9/ 2, 9/ 3 and 10 of Raghavapatnam Village, Raghavapatnam Grama Panchayat, Routhulapudi Mandal, East Godavari District.
2) Learned counsel for the petitioner submits that if the names of the respondents 5 and 6 are mutated in the revenue records, grave injustice would be caused to the petitioner, though the respondents 5 and 6 have a decree in their favour. 3) The Government Pleader for Revenue (AP) submits that since the application of the respondents 5 and 6, for mutation of their names is pending consideration before the Tahsildar, the petitioner can as well raise an objection, in which event the Tahsildar may be directed to consider the same. 4) Having regard to the fact that the application made by the respondents 5 and 6 for mutation of their names in the revenue records is still pending consideration, the petitioner herein shall
forthwith make an application raising an objection with regard to mutation, in which event, the fourth respondent shall deal with the application and the objections raised, in accordance with law after hearing all concerned, as early as possible. 5) With the above direction, the Writ Petition is disposed of. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. _________________________ JUSTICE C.
