THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.31750 of 2018 ORDER:

Heard the counsel for petitioner, and the learned Government Pleader for Prohibition and Excise, for respondents.

The counsel on both sides state that the issue raised in this Writ Petition is covered by the order, dated 26.12.2017, passed in WP.No.44088 of 2017.

Therefore, for reasons alike, the present Writ Petition is disposed of, directing the second respondent to release the Tata Mini Truck belonging to petitioner bearing registration No.AP-01-Y-3759 subject to final orders to be passed in the criminal proceedings, and on petitioner furnishing a fixed deposit of Rs.40,000/- from any nationalized bank in favour of the second respondent, and also on production of original R.C. book and on petitioner further giving an undertaking that he will not transfer or alienate the vehicle to any third party in any manner and will maintain the vehicle in the same good road-worthy condition without changing its major parts and features, and would produce the same as and when directed to be produced before the competent authority.

Accordingly, the Writ Petition is disposed of with the above directions. No order as to costs.

As a sequel thereto, miscellaneous petitions pending if any in this Writ Petition, shall stand closed. __________________ A.V.SESHA SAI,J 05th September, 2018 Tsy
