Heard.
The petitioner claims to be in possession and enjoyment of the land admeasuring Ac.0-40 cents in Sy.No.515/2 situated at Ganapavaram Village, Karlapalem Mandal, Guntur District, since 1985. He contends that though he is eligible for assignment and has been paying land revenue, respondents 4 and 5 are trying to evict him and allot the said land to the Gram Panchayat. Apprehending that he will be evicted without notice, the petitioner filed the present writ petition.
Learned Government Pleader for Revenue has received instructions, which state that the land claimed by the petitioner belongs to R & B Department and no requisition so far been received from R & B Department and hence, no action has been initiated against the petitioner for eviction. In view of that, the apprehension of the petitioner in this writ petition is clearly misplaced. However, as and when the 4th respondent seeks to take any action against the petitioner, he shall follow due process of law and take appropriate action in accordance with law.
