THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO. 13934 OF 2015 ORDER:

There is no representation on behalf of the petitioner. 2.

Heard the learned Government Pleader appearing for the respondents.

The prayer sought in the Writ petition is as under: " ...to issue an order, writ or direction more particularly in the nature of Writ of Mandamus declaring the action of the respondents No. 2-5 in removing the contract work of the petitioner in running mid day meals work in M.P.U.P. School, Kojjepalli Village, Gooty Mandal, Anantapur District vide proceedings Rc.No. C/ 166/ 2015 dated: Nill-042015 issued by the office of 5th respondent without following any procedure and without there being valid reason and without considering explanation submitted by the petitioner as illegal, arbitrary and violative of principle of natural justice and violative of Articles 14, 19(1)(g) of the Constitution of India and consequently set aside the same."

The basic grievance of the petitioner is that her services on contract basis for providing mid day meals in M.P.U.P. School, Kojjepalli village, Gooty Mandal, Anantapur district were disengaged without following any procedure and without there being any valid reason.

During the course of hearing, learned GP placed on record the letter in Rc.No.8856/ B3/ MDM/ 2015 dated 30.11.2018 addressed by the District Educational Officer, Ananthapuramu to the office of the Government Pleader, School Education. A perusal of the said letter would indicate that as per the report of the three men committee, the case of the petitioner was examined and she was removed as mid day meal agent for violation of the norms

prescribed in GO.Ms.No.94 S.E.

(Prog-I) department dated 25.11.2002 and a new agent is serving the mid day meals to M.P.U.P. School, Kojjepalli village. In the said letter, it is also mentioned that the SMC of the school also constituted a Committee with the Headmaster and passed a resolution to remove the petitioner.

The said letter dated 30.11.2018 is made part of the record. 7.

In the light of the said letter, no further cause would survive in the Writ Petition.

Accordingly, the Writ Petition is dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
