This Writ Petition is filed challenging the action of the 3rd respondent in filing petition dated 16.07.2018 before the VI Additional Junior Civil Judge, Guntur in Cr.No.10 of 2016 of Vatticherukuru Police Station, Guntur Urban District, for disposal of cotton bales belonging to petitioner preserved with the 5th respondent, without following due process of law and consequently to stay the same.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home appearing for respondents 1 to 3.

Learned Assistant Government Pleader for Home appearing for respondents 1 to 3 submits that no order is passed as on to day on the petition filed by the 3rd respondent and that the petitioner is also party to the said petition. Learned counsel for the petitioner raised several grounds against the 3rd respondent in filing the said petition. Since, the petition filed by the 3rd respondent is stated to be pending before the VI Additional Junior Civil Judge, Guntur in Cr.No.10 of 2016 of Vatticherukuru Police Station, Guntur Urban District, petitioner can agitate his grievance in the said petition and raise all the grounds raised herein and

that the VI Addl. Junior Civil Judge, Guntur, will consider the same before passing any order on the petition filed by the 3rd respondent.

With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, shall stand closed. _______________________________ A.RAJASHEKER REDDY, J 06-09-2018.
