When the matter is taken up for hearing, the learned counsel for the petitioner seeks permission of the Court to withdraw the Criminal Petition with liberty to file discharge petition before the trial Court.

Permission, as sought for, is accorded.

Accordingly, the Criminal Petition is dismissed as withdrawn granting liberty as prayed for, provided the charges are not framed in the Calendar Case.
