HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.31827 of 2018 ORDER:

The petitioner herein filed the present Writ Petition questioning the action of the respondents 2 to 4 in mutating the name of the 5th respondent in the revenue records and planning to issue pattadar pass books infavour of 5th respondent, in respect of the land in Sy.No.187/A at Ainapur village, Komeravelli Mandal, Siddipet District, as illegal, improper and arbitrary. 2) The petitioner herein claims to be the absolute owner and possessor of the land to an extent of 0.28 guntas and also having the land in Sy.No.202/A. After the demise of Rama Lingaiah, the said land devolved upon the petitioner and his brothers and since then the same is in possession and enjoyment of the petitioner.

In the year 2010 the Government acquired land for the purpose of construction of "Chokkarao lift irrigation dam" and in the said acquisition, the land of the petitioner was also covered under the notification. But the petitioner was not paid compensation for the acquisition of his land. Then the petitioner made a representation dated 11.10.2010 to the District Collector and again in the year 2015 with the very same request.

Immediately, the petitioner got issued a legal notice dated 21.06.2016 directing the respondents not to change the name of the petitioner in the ROR records without following due process of law. It is said that inspite of repeated efforts made by the petitioner, the authorities have changed the name of the petitioner in the pattadar pass book and a copy of which was also obtained by the petitioner through the web site. Challenging the same, the present Writ Petition came to be filed. 3) Though the learned counsel for the petitioner tried to contend that the name of the petitioner is found in the web as on 10.04.2018, but at the same time he tries to contend that the name of the petitioner came to be changed in the revenue records and pattadar pass books are sought to be issued to the unofficial respondent.

It is to be noted that in the month of May 2015 itself the petitioner made a representation, which discloses that, in relation to the land in Sy.Nos. 202/A and 187/A, the name of one Dandyala Mallareddy was shown in "Possession" column. In view of the above, an intimation about the same came to be passed on to the V.R.O., who is said to have informed that the said person purchased the said land. Hence, it is alleged that a false document is created with an intention to enter the name of the unofficial respondent in the revenue records. But at the same time, it is to be noted that the copy of the patta Adangal dated 01.04.

These issues, in my view cannot be sorted out basing on the representations, unless one challenges the entries made therein before the appropriate forum. 4) Accordingly, the Writ Petition is disposed of giving liberty to the petitioner to challenge the entries made therein before the appropriate forum.
