HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITON No. 36305 OF 2016 O R D E R:
This Writ Petition is filed to declare the order of the 2nd respondent Deputy Commissioner of Prohibition & Excise, Kurnool bearing Rc.No.B1/275/2016 dated 09.09.2016 rejecting release of seized stock of 47 bags of black jaggery, as arbitrary and illegal. Inasmuch as an Appeal lies against the order impugned to the Commissioner of Prohibition & Excise, under Section 63(2) of the Andhra Pradesh Excise Act, 1968, this Court is not inclined to entertain the Writ Petition. However, liberty is granted to the petitioner to approach the 2nd respondent, by invoking the provisions of Section 63(2) of the Act. If an Application is made by the petitioners within ten days from today, the same shall be considered and appropriate orders be passed within two weeks thereafter, in accordance with law.
The Writ Petition is accordingly disposed of. No costs. Consequently, the miscellaneous applications, if any, shall also stand disposed of.
