THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Crl.P.M.P.No.3147 of 2015 in Crl.P.No.2959 of 2015 and Crl.P.No.2959 of 2015 Common Order:

The de-facto complainant and his counsel Sri Sk. Rizwan Ali are present. Accused No.1 and his counsel Sri N. Ravi Prasad are present. On the report given by de-facto complainant, the police of Rajahmundry Urban Police Station, East Godavari District, registered FIR No.87 of 2015 against the accused for the offences under Sections 323, 324, 506 and 34 of IPC and Section 3 (1) (x) of SCs & STs (POA) Act, 1989 and the investigation is reported to be pending. Be that as it may, today the parties and their counsel present in Court and submitted that at the intervention of elders, they have amicably settled the disputes and they wanted to live peacefully and as such, the de facto complainant has no objection for quashment of the proceedings in FIR No.

87 of 2015 and as such permission may be accorded to them to compound the offence and quash the proceedings in the interest of justice. Having regard to the above said submission and in view of the fact that the parties are known to each other and they want to settle the disputes between them and no useful purpose will be served even if the investigation is ordered to be continued since the parties have amicably resolved their disputes and following the decision reported in Gian Singh v. State of Punjab and another (2012)10 SCC 303, Crl.P.M.P.No.3146 of 2015 is allowed and permission is accorded to compound the case. Consequently, the Criminal Petition is allowed and the Proceedings in FIR No.

87 of 2014 on the file of Rajahmundry Urban, East Godavari District, are quashed against the accused, as per the compromise petition filed by the parties, by compounding the offence.
