HON'BLE SRI JUSTICE SURESH KUMAR KAIT WRIT PETITION No.24931 of 2016 ORDER:
The present petition is filed on the ground that, in the year 1992, the third respondent - Company (Singareni Collories Co. Ltd) proposed to acquire an extent of Ac.21.05 gts., in various survey numbers, including Sy.No.397 situated at Bhupalpally Village & Mandal, Warangal District, for the purpose of Township of Singareni Collories and laying roads, but no action has been taken till date. Learned counsel appearing on behalf of the petitioner submits that, in the last week of July, 2016, the officers of the third respondent - Company visited the land of the petitioner and made markings without even issuing notice to him. He further submits that, if the time for acquisition of land elapsed and if the respondents ought to acquire land after five years, they are supposed to issue notice to the petitioner, which they fail to do so.
As stated by the learned counsel for the petitioner, the respondents are taking action which is contrary to the principles of natural justice. Therefore, I make it clear that, if the respondents intend to acquire land of the petitioner, they shall follow the procedure as per law.
Accordingly, the Writ Petition is disposed of. Miscellaneous Petition pending, if any, shall also stand disposed of. However, in the circumstances, without costs.
