THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.4987 OF 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: "to issue a writ of mandamus or any other appropriate writ or writs, order or direction, declaring the action of the respondents in not paying the ex-gratia of Rs.4,00,000/- to the petitioners in connection with accident occurred to the deceased Varikuppala Jangaiah due to the electrical shock on 12.05.2016 at Bogguladona Village, Dindi Mandal, Nalgonda District as per the Proceedings No.

TSERC/Secy/86 of 2015 dated 28.12.2015 in the case of Non-Departmental Fatal accidents as illegal, arbitrary and consequently direct the respondents to pay the ex-gratia of Rs.4,00,000/-."

Heard Sri Dr.Uma Shankar Nemmikanti, learned counsel for the petitioners, Sri J.Aswini Kumar, learned Standing Counsel appearing for respondent No.1 and Sri R.Vinod Reddy, learned Standing Counsel appearing for respondent Nos.2 to 4 apart from perusing the material available on record.

When the matter is called, it is submitted by the learned counsel for the petitioners that for redressal of grievance of the petitioners herein, the petitioners submitted a representation to the respondents on 07.11.2016 and no action has been taken on the said representation and necessary direction may be given to the respondents to consider the same in accordance with law.

The said request is not opposed by the learned Standing Counsel, who submitted that the said representation will be considered in accordance with law.

For the aforesaid reasons, the Writ Petition is disposed of, directing the respondents to take appropriate action on the representation, dated 07.11.2016, said to have been submitted by the petitioners herein within a period of eight (8) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
