THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.14304 of 2025 ORDER:

This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused No.1 in FIR No.208 of 2025 of Balanagar Police Station, Mahabubnagar District, registered for the offences punishable under Section 61(2), 191(2), 191(3), 109 read with 190 of BNS and Section 27 of Arms Act. 2.

The brief facts of the case are that on 10.07.2025, the de facto complainant lodged a report with the police stating that he had taken his daughters to KGBV Hospital in his car bearing registration No. TS06UA0980, situated at Chennagula Gadda Thanda, to join them in the hostel. When they reached the hostel gate, five unknown persons arrived in a white Innova car. The complainant alleged that the driver of that vehicle tried to dash his car, due to which he fell to the ground and sustained severe bleeding injuries to his right hand. He further stated that when he regained consciousness, he saw the said persons carrying deadly weapons, including knives and iron rods. Out of fear, he hid in a nearby house. After the assailants left, he found that one deadly weapon had been thrown at the spot. The complainant further stated that he is engaged in real estate business and suspects that some opponents of his business may have attempted to attack him deliberately. Hence, he requested to take necessary action. Basing on

the said complaint, the police registered a case for the above said offences.

Heard Ms.Mogili Anaveni, learned counsel appearing on behalf of the petitioner as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor for respondent-State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the said offences. It is further submitted that even according to the prosecution, the petitioner was not present at the scene of the offence and has been falsely implicated. The petitioner has been in judicial custody since 13.10.2025 and the material part of the investigation has already been completed. It was also pointed out that all other accused have been granted bail. Therefore, he prayed the Court to grant regular bail to him by allowing this criminal petition.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the allegations against the petitioner are of a serious and grievous nature. It is further submitted that the petitioner is involved in 15 cases and in view of the same, he is not inclined to grant regular bail. Therefore, he prayed the Court to dismiss the criminal petition.

Considering the submissions made by both learned counsel and upon perusal of the material on record, it is noted that according to the learned Additional Public Prosecutor, 15 cases are pending, whereas the learned counsel for the petitioner submitted that 12 cases have already been concluded. The petitioner has been in judicial custody since 13.10.2025. Further, it is observed that almost all material witnesses have already been examined. Considering the facts and circumstances of the case, this Court finds it appropriate to grant bail to the petitioner/accused No.1 subject to the following conditions. i.

The petitioner/accused No.1 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned Principal Judicial Magistrate of First Class at Jadcherla.

ii.

The petitioner/accused No.1 shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner/accused No.1 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).
