The grievance of the petitioners is that they belong to Scheduled Tribe and they have migrated from Odhisha State from Minzari Village, Gajapathi District to Andhra Pradesh and they made representation for grant of Schedule Tribe certificates to the competent authority i.e. the 4th respondent-Tahsildar and the 4th respondent issued endorsement dated 19-10-2016 for production of documents and the petitioners submitted documents as required in the said endorsement. Inspite of the same, their applications are not considered and no orders are passed. Aggrieved by the same, the present writ petition is filed.
Heard learned counsel for the petitioners.
Learned Assistant Government Pleader for Revenue submits that unless relevant material regarding migration and that they belong to Scheduled Tribe are produced, community certificates cannot be issued to the petitioners as they belong to Scheduled Tribe.
The assertion of the petitioners is that they have produced necessary documents in pursuance to the endorsement dated 19-10-2016.
In view of the same, the competent authority is directed to dispose of the representation of the petitioners dated 12-10-2015, 19-09-2017 and 27-02-2017 in accordance with law and take action accordingly within a period of two months from the date of receipt of a copy of this order.
With the above direction, this writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
