HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.22191 OF 2016 ORDER:
This petition is filed for a writ of Mandamus declaring the action of the 3rd and 4th respondents in not considering the representation dated 06.06.2016 submitted by the petitioner for cancellation of pattadar pass books and title deeds issued in favour of the 5th respondent in respect of the subject property Heard both sides.
As per the judgment reported in Ratnamma v. Revenue Divisional Officer, Dharmavaram, Anantapur District and others[1] the Revenue Divisional Officer has no power to initiate proceedings against the cancellation of Pattadar Pass Books and Title deeds. In view of the same, no direction can be issued to the 3rd respondent for considering the application of the petitioner.
Accordingly, the writ petition is misconceived and the same is dismissed. However, it is open for the petitioner to avail remedy available under Section 9 of the Andhra Pradesh Rights in Land and Pattedar Pass Books Act, 1971, in respect of his grievance. No order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
