HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5027 OF 2015 ORDER:
This Criminal Petition is filed by the petitioners/accused under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.14 of 2015 of Pattabhipuram Police Station, Guntur District, for the offence punishable under Sections 498-A I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act.
Heard the learned counsel for the petitioners and the learned Public Prosecutor (Andhra Pradesh) for the State before notice to respondent No.2/de facto complainant and before admission. Perused the material on record. As the material falls short for this Court to admit the application under Section 482 Cr.P.C, the same is disposed of giving liberty to the petitioners to surrender before the learned Magistrate concerned and move an application for regular bail with notice to Additional Public Prosecutor and in such an event the learned Magistrate concerned shall hear and grant bail on the same day with necessary conditions. Needless to say, at the post bail stage pending investigation their presence can be dispensed with. The petitioners are at liberty to file any material available with them to prove their innocence to submit to investigating officer to consider as part of the investigation record.
