THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3282 OF 2016 ORDER:

This petition is filed by the petitioner-accused under Section 482 Cr.P.C. seeking to quash the proceedings in C.C.No.538 of 2014 on the file of the IV Additional Chief Metropolitan Magistrate, Hyderabad. Heard and perused the material available on record. The petitioner is alleged to have committed the offence punishable under Sections 420, 406, 447 and 506 IPC. It is alleged that one Manohar Goud offered to sell the machinery existing in his unit for total amount of Rs.10 lakhs and the 2nd respondent paid the said amount. Later, the 2nd respondent filed a private complaint against the said Manohar Goud and the same was referred to the police station.

In order to settle the matter, the petitioner, who is the paternal uncle of the said Manohar Goud intervened and the said Manohar Goud executed understanding-cum-agreement and in that connection, the petitioner issued cheques in favour of the 2nd respondent and the said cheques were dishonoured. Considering the facts and circumstances of the case and the allegations made against the petitioner, this Court is not inclined to grant the relief sought by the petitioner.

At this stage, the learned Counsel for the petitioner has sought for dispensing with the presence of the petitioner before the trial Court. In view of the above submission, the presence of the petitioner before the trial Court is dispensed with except on the dates when his presence is specifically insisted by the trial Court. The petitioner is directed to be represented through a Counsel before the trial Court on all hearing dates.

Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
