HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.3446 OF 2017 ORDER:

This Criminal Petition is filed by the petitioners/ A.3 to A.7 and A.9 to A.12 in C.C. No.4 of 2016 seeking to quash institution and continuation of proceedings in said case on the file of III Additional Special Judge for CBI Cases, Visakhapatnam registered for the offences punishable under Sections 120-B r/ w 420, 409, 467, 468, 471 and 477-A of I.P.C and Section 13 (2) r/ w 13 (1) (d) of Prevention of Corruption Act, 1988.

2) Heard learned counsel for petitioners and also learned Spl. Public Prosecutor for CBI and perused the material on record. 3) As stated by both the parties, the matter undisputedly at the stage of trial, which is in progress.

4) Having regard to the above, the Criminal Petition is disposed of leaving all the defences available to petitioners/ A.3 to A.7 and A.9 to A.12 and permitting them to file an affidavit under Rule 37 of Criminal Rules of Practice and the trial Court is directed to permit one of the petitioners/ A.3 to 7 and A.9 to A.12 to represent others as and when personal appearance is required. 5) As a sequel, miscellaneous petitions if any pending shall stand closed.
