O R D E R

The petitioner has been working as Assistant Executive Officer in the office of the 3rd respondent - Society. By proceedings of the 3rd respondent -Executive Director, District Backward Classes Services Co-operative Society Ltd., dated 31.03.2017 he was retired from service at the age of 58. Aggrieved by the action of the respondents in retiring him at the age of 58 years instead of 60 as per the judgment of the Apex Court in SLA ©.Nos.14033-14034 of 2017 dated 5.5.2017 and G.O.Ms.No.102 Finance (HR-IV-FR) Department dated 27.6.2017, the present writ petition has been filed.

The learned counsel for the petitioner submits that subsequent to filing of the writ petition, Government have issued G.O.Ms.No.138 Finance (HR.IV-FR) Department dated 8.8.2017 enhancing the age of superannuation to the employees working in the State Public Sector Undertakings and Institutions included in Schedules IX and X of A.P. ReOrganization Act, 2014. He further submits that the petitioner made a representation dated 10.08.2017 to the respondents and the same may be directed to be considered.

The learned Assistant Government Pleader for Co-operation also submits that the representation of the petitioner may be directed to be disposed of.

In view of the above facts and circumstances and the submissions of the learned counsel, the writ petition is disposed of directing the 2nd respondent - Vice Chairman and Managing Director to consider the representation of the petitioner dated 10.08.2017 in terms of G.O.Ms.No.138 dated 8.8.2017 and take appropriate action in accordance with law, within a period of one week from the date of receipt of a copy of this order. No costs.
