THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.1650 OF 2016 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
The petitioner questions the notice dated 27.04.2015 under Rule 3 of the A.P. Assigned Lands (Prohibition of Transfers) Act, 1977 issued to him on various grounds. It is however, stated by the learned Government Pleader for Revenue on instructions that pursuant to the said notice resumption order was already passed in Rc.No.505/2015, dated 29.05.2015. A copy of the resumption order is also given to the learned counsel for the petitioner. In view of the same, the petitioner will have to approach the appropriate appellate authority. Hence, the relief sought for in this writ petition cannot be granted except permitting the petitioner to approach the appellate authority. Since the petitioner is stated to be resident of USA and is looking after his land by General Power of Attorney, he is granted two weeks time to approach the appropriate authority against the aforesaid resumption order.
The status quo as existing as on today with regard to the lands in question shall be maintained for a period of two weeks, within which time, the petitioner is at liberty to take appropriate orders from the appellate authority.
With the above direction, the writ petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in the writ petition shall stand closed.
