THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.32181 of 2015 ORDER:

The petitioner was appointed as a fair price shop dealer of shop No.22, Engilibanda Village, Gooty Mandal in Anantapuram District. It is stated that the petitioner is having 83% disability. However, the third respondent inspected the shop on 18.08.2015 and submitted a report on the same date to the second respondent. The second respondent, on the basis of the said report, issued a show cause notice on 24.08.2015. The petitioner submitted his explanation through his Counsel on 08.09.2015. After receipt of the explanation, the impugned order of suspension pending enquiry was passed on 16.09.2015. Challenging the same, the present Writ Petition is filed. This Court carefully perused the charges and the impugned order passed by the second respondent.

In view of the nature of the charges and the order passed, this Court is not inclined to entertain the present Writ Petition, and the Writ Petition is, accordingly, dismissed. However, the second respondent is directed to conduct an enquiry in respect of the allegations and pass final orders thereon after giving due opportunity to the petitioner, within a period of three months from the date of receipt of a copy of this order. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
