HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.31849 OF 2018 ORDER:

Aggrieved by the action of the 3rd respondent in not investigating the matter in connection with Cr.No.163/2016, dated 28.06.2016, this Writ Petition is filed. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home appearing for respondents 1 to 3.

Learned Assistant Government Pleader for Home appearing for respondents 1 to 3 basing on instructions submit that Crime No.163 of 2016, dated 28.06.2016 is investigated into and filed report before the concerned Court and that the petitioner was also issued notice on 28.04.2017. Since it is stated that report in Crime No.163 of 2016 is filed before the concerned Court, the petitioner has alternate remedy of filing protest petition before the said Court.

In view of the same, this Court is not inclined to entertain the Writ Petition. However, this Writ Petition is disposed of granting liberty to the petitioner to file avail alternate remedy of filing protest petition before the concerned Court, if he is so advised.

There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, shall stand closed. _______________________________ A.RAJASHEKER REDDY, J 06-09-2018.
