THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.21419 OF 2017 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the inaction on the part of the 3rd respondent in not taking any action against the respondents 6 to 9 herein pursuant to the inquiry report submitted by the 4th respondent in R.O.C.No.l95/2012-B dated 02-05-2017 where under the 4th respondent recommended for recovery of the amounts misappropriated by the respondents 6 to 9 herein and for taking necessary action against them, is illegal, arbitrary, and consequently direct the 3rd respondent to initiate necessary action against the respondents 6 to 9 herein pursuant to the inquiry report submitted by the 4th respondent in R.O.C.No.l95/2012-B dated 02-05-2017, and pass such other relief or reliefs as this Hon'ble Court may deems fit and proper in circumstances of the case."

Heard the learned counsel for the petitioner and also the learned Assistant Government Pleader for Panchayat for the respondents 1 to 4 and learned standing counsel, Sri G.Seshari, for the 5th respondent, offers to file vakalat, saying from their respective oral instructions and perused the

prayer in the writ petition with supporting affidavit and the other material on record.

It is the submission by the learned Assistant Government Pleader for Panchayat Raj and learned standing counsel respectively for the official respondents supra that pursuant to the complaint of the petitioner, the action is in process.

Having regard to the above, this writ petition is disposed of, by directing the respondents to intimate to the petitioner what is the action taken on his complaint, within four weeks from today and any further action to be completed also to so intimate and after completion of the action taken also thereafter.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
