THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.38249 of 2016 ORDER:

The petitioner prays for the following relief :- " ..... to issue a Writ, order or directions, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents 2 and 3 in not clearing the final bill in respect of construction of College Building to Sri Padmavathi Medical College for Women at Tirupati in Chittoor District, by adopting G.O.Ms.No.35, Transport, Roads & Buildings (R.1) Department, dated 30-01-2009 as per G.O.Rt.No.112, Health, Medical & Family Welfare (H.2) Department, dated 26-02-2015, issued by the 1st respondent directing the 2nd respondent to adopt the G.O.Ms.No.35, in respect of ongoing works executing in Andhra Pradesh Medical Services and Infrastructure Development Corporation w.e.f.

17-11-2004, in spite of the petitioner representations dated 31-08-2015, 08-03-2016 and 14-09-2016, to clear final bill in respect of construction of College Building to Sri Padmavathi Medical College for Women at Tirupati in Chittoor District, though the said work was completed by 21-10-2015, which is illegal, arbitrary, unjust, contrary to Rules, violation of principles of natural justice and in violation of Articles 14, 16 and 21 of the Constitution of India and consequently direct the respondents herein to clear final bill ....."

Heard Sri C.Shiva Shanker for petitioner and Sri C.Appaiah Sharma for respondents 2 to 5.

Counsel for petitioner has confined his submission to the limited extent of directing respondents 2 to 5 to decide the request made through representations dated 31-08-2015, 08-03-2016 and 14-09-2016 within reasonable time.

The Standing Counsel does not oppose the limited prayer of petitioner.

Hence, the writ petition is disposed of by this order. Respondents 2 to 5 are directed to take a decision on the representations dated 31-08-2015, 08-03-2016 and 14-09-2016 within eight weeks from the date of receipt of a copy of this order and positively communicate the same to petitioner.

The writ petition is disposed of accordingly. No order as to costs.
