ORDER:
This writ petition is filed feeling aggrieved by the inaction of respondent No.2 in responding to the petitioner's representation dated 11.04.2015 for removal of obstruction made by third parties by raising a basement over public passage.
At the hearing, Sri G.Narender Reddy, learned Standing Counsel for Panchayat Raj Institutions (TS), appearing for respondent No.2, on instructions submitted that the basement which is objected to by the petitioner through her representation is raised over a private passage and that as the said passage is not vested in the Gram Panchayat, no action is taken. The learned Standing Counsel, however, submitted that respondent No.2 has not sent any communication to the petitioner in writing on her representation.
In the light of these facts, this Court is of the opinion that respondent
No.2 shall send its response to the petitioner on her representation in order to enable her to avail appropriate legal remedy if she is not satisfied with such response.
In this view of the matter, without expressing any opinion on the respective pleas of the parties, the writ petition is disposed of with the direction to respondent No.2 to communicate its stand on the petitioner's representation within two weeks from the date of receipt of a copy of this order. The petitioner shall be entitled to avail appropriate legal remedy if she feels dissatisfied with such communication.
As a sequel to disposal of the writ petition, WP.M.P.No.15599 of 2015 shall stand disposed of as infructuous.
