THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.25463 of 2017 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents. The case of the petitioner is that she was appointed by the fourth respondent as the fair price shop dealer of shop No.17 of Kajavaripalem Village, Duggirala Mandal in Guntur District, vide proceedings dated 20.02.2014. She is an organizer of Sri Gayatri DWCRA Group. While so, when the fourth respondent issued a notification on 20.07.2017 to fill up the post on permanent basis in the category of OC women, the present Writ Petition is filed on the ground that she also belongs to the same category and without making her permanent, now the notification is issued.

Admittedly, the petitioner is a temporary dealer and vacancy has to be filled up on permanent basis. When the vacancy is sought to be filled up on permanent basis by the fourth respondent, the petitioner cannot object. If the petitioner is also eligible for appointment on permanent basis, the petitioner also can apply and it is for the fourth respondent to consider the case of the petitioner along with the other eligible persons in accordance with law.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 01.08.2017 vs
