HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19659 OF 2017 ORDER:

This writ petition is filed challenging the proceedings vide Rc.No.45/2015, dated 16.03.2015 issued by the 5th respondent asking the petitioner to submit explanation as to why disciplinary action should not be initiated against him.

Learned counsel for the petitioner submits that as per the Mahatma Gandhi National Rural Employment Guarantee Scheme by which the petitioner was appointed, the 5th respondent has no power to take disciplinary action against the petitioner. On the other hand learned Government Pleader for Panchayat Raj and Rural Development produced written instructions dated 29.06.2017 of the 4th respondent wherein it is stated that the petitioner has submitted representation dated 07.03.2017 stating that he could not attend the duties as he met with an accident on 01.02.2015 and suffering with B.P., Sugar, Diabetics and Jaundis; and sought to consider his case.

In view of the aforesaid facts and circumstances, since it is stated that the petitioner has already submitted representation dated 07.03.2017 seeking to consider his case, without expressing any opinion on merits, the impugned notice dated 16.03.2015 is set aside and the 4th respondent is directed to dispose of the representation of the petitioner, in accordance with the Rules and take action accordingly, within a period of one month from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
