THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.11423 of 2015 ORDER:

This petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings against the petitioner/accused in C.C.No.174 of 2015 on the file of Principal Junior Civil Judge, Eluru, West Godavari District. At the time of arguments, learned counsel for the petitioner has sought permission of this Court to permit the petitioner to withdraw the criminal petition with a liberty to avail the remedies available to him under law including filing of petition to recall NBW issued against him and to urge the grounds raised in this petition before the trial Court.

Permission is granted.

Hence, the Criminal Petition is dismissed as withdrawn with a liberty to the petitioner to avail all the remedies available to him under law including filing of petition under Section 70(2) Cr.P.C. If the petitioner appears personally and files the petition to recall NBW issued against him, the trial Court is hereby directed to dispose of the same in accordance with law on the same day. The petitioner is also at liberty to urge the grounds raised in this petition before the trial Court. Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
