This writ petition is filed challenging the preliminary decree dated 05.11.2001 passed in O.S. No.176/1996 on the file of Junior Civil Judge, Ibrahimpatnam, Rangareddy District. Learned counsel for the petitioners fairly submits that the present writ petition is not maintainable and he seeks permission of this Court to withdraw the writ petition with a liberty to avail alternative remedy available under law.

Permission is accorded.

Accordingly, this Writ Petition is dismissed as withdrawn giving liberty to the petitioners to avail alternative remedy available under law. No order as to costs.

Miscellaneous Petitions pending, if any, shall stand closed.
