THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.27981 of 2012 ORDER:

The grievance of the petitioner was that the police authorities were not closing the rowdy sheet opened in his name on the file of the Mills Colony Police Station, Warangal District. The Sub-Inspector of Police, Matwada Police Station, Warangal District, filed a counter-affidavit stating that though the rowdy sheet was opened in the name of the petitioner on the file of the Mills Colony Police Station, Warangal District, it was transferred to Matwada Police Station, Warangal District, thereafter. He further stated that the two criminal cases in which the petitioner was involved had ended in acquittal in the year 2006 but the rowdy sheet was extended up to 31.12.2012 as per the orders of the Sub-Divisional Police Officer, Warangal District. He conceded that the petitioner was not involved in any case thereafter insofar as the Matwada Police Station was concerned, but as he was young and energetic, the rowdy sheet was being continued.

Ms.Vladimeer Khatoon, learned counsel representing Sri Mirza Nisar Ahmed Baig Nizami, learned counsel for the petitioner, states that he is not involved in any criminal activity and no criminal case has been registered against him, presently.

The learned Assistant Government Pleader for Home states that he had no instructions as to the present state of affairs, as the counteraffidavit aforestated was filed as long back as in September, 2012. In that view of the matter, the writ petition is disposed of permitting the petitioner to make a suitable representation to the Superintendent of Police, Warangal District, seeking closure of the rowdy sheet opened in his name. In the event such a representation is made, the Superintendent of Police, Warangal District, shall consider the same on its own merits and in accordance with the relevant regulations and take appropriate action in the matter thereafter.

Pending Miscellaneous Petitions shall stand closed in the light of this final order. No order as to costs.
