THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.3185 of 2016 ORDER :

In this Writ Petition, petitioner is questioning the proceedings dt.23.12.2015 of the 2nd respondent suspending the petitioner's Fair Price Shop Dealership authorization and also issuing a show-cause notice to him to show cause why action against him under the A.P. State Public Distribution System (Control) Order, 2008 should not be initiated against him.

2. It is not disputed that the petitioner has already submitted his explanation to the 2nd respondent against the proposed action.

3. Although counsel for the petitioner contended that the allegations leveled against the petitioner are false and that the variation in stock was due to mechanical defect in the E Pos machine in recording the stocks, this being a matter for enquiry, I am not inclined to interfere with the same at this stage.

4. Therefore, the Writ Petition is disposed of directing the 2nd respondent to complete the enquiry into the allegations against the petitioner on or before 23.03.2016 in accordance with Sub-Clause(5) of Clause(5) of the A.P. State Public Distribution System (Control) Order, 2008 and pass a reasoned order by providing a personal hearing to the petitioner. There shall be no order as to costs.

5. Consequently, miscellaneous petitions pending, if any, in this Writ Petition shall stand closed.
