THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8545 of 2015 ORDER:

This criminal petition is filed by the petitioner-Accused No.1, under section 438 of the Code of Criminal Procedure, seeking grant of anticipatory bail in Crime No.66 of 2015 on the file of I-Town Police Station, Adoni, Kurnool District, registered for the offences punishable under Sections 420 and 408 IPC. Heard and perused the material available on record. The allegation against the petitioner is that he misappropriated the amounts collected from the distributors of the de facto complainant, without paying the same to him.

Learned counsel for the petitioner submitted that the investigation is completed and the charge sheet has also been filed and the NBWs are pending against the petitioner.

In view of the same, this Court is inclined to pass the following order: The petitioner is directed to approach the Court concerned and file an application to recall the warrant issued against him and on such filing of the application the Court concerned is directed to recall the warrant on the same day on condition of petitioner executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for the like sum and on further condition to appear before the Court concerned, regularly.
