THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.14356 of 2025 ORDER:
This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused in FIR No.885 of 2025 of Banjara Hills Police Station, Hyderabad, registered for the offences punishable under Section 69 of the Bharatiya Nyaya Sanhita (for short 'BNS').

The brief facts of the case are that on 30.10.2025, the defacto complainant, a widow residing with her daughter, lodged a report with the police stating that she had become acquainted with the petitioner in 2022 through Instagram. They were in a relationship from 2022 until 2025, during which time the petitioner consistently expressed his love for her and assured her of his intention to marry her, despite being informed that she was previously married and had a daughter. However, the petitioner later broke his promise, stating, "Not only you, I won't marry anyone," and subsequently abused her with offensive language and allegedly cheated her. Hence, she requested the
police to take necessary action. Basing on the said complaint, the police registered a case for the above said offence. 3.
Heard Sri Gafar Mahammad, learned counsel appearing on behalf of the petitioner as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor for respondent. 4.
Learned counsel for the petitioner submitted that the petitioner is a 20-year-old degree student and, as per the defacto complainant's own version, their relationship spanned from 2022 to 2025 and that during the initial period of the alleged relationship, the petitioner was a minor, and no promise of marriage was ever made by him. He further submitted that the allegations leveled against the petitioner are false, baseless, and made without any proper investigation, and that the police registered the case in a mechanical manner. Therefore, he prayed the Court to grant regular bail to him by allowing this criminal petition.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the allegations against the petitioner are serious in nature. However, he
admitted that the petitioner is aged about 20 years, which is also reflected in the remand report.

Considering the submissions made by both learned counsel and upon perusal of the material available on record, and taking into account the age of the petitioner as well as the de-facto complainant, along with the overall facts and circumstances of the case, this Court finds it appropriate to grant bail to the petitioner/accused subject to the following conditions:
i.
The petitioner/accused shall execute a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only), with two sureties for a like sum each to the satisfaction of the learned III Additional Chief Judicial Magistrate at Nampally, Hyderabad.
ii.
The petitioner/accused shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner/accused shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
